Anyway, if you have work being distributed on that site, find it, copy the link in a email to the host and domain registrar indicating that you are the copyright owner of said work, and request the site be suspended / taken down. You will have to supply proof that the work is in fact yours, however if the host is legitimate, than they should abide and remove the site.
False claims of lawsuits that you cannot stand behind are worthless. Going about this in the most professional manor with the host and registrar I think is the only way you can have any chance of your work, and/or the site from being removed.
I will say, the person I contacted on Yahoo must have taken what I said seriously, as they removed most of the vbhackers graphics from thier site. Maybe if you too contact them and refer to the content in question, they will remove it too.
